BCFSA Required Disclosure

Your Relationship with a
Real Estate Professional

In British Columbia, real estate professionals are required by law to provide this disclosure before offering real estate services.

This Is Not a Contract

This form does not create a client relationship and does not obligate you to buy, sell, or sign anything further. It is strictly an information and disclosure document.

What This Form Explains

The form explains that you can work with a real estate professional in one of two ways:

Option 1

As a Client

  • Full legal representation
  • Duty of loyalty to you
  • Full disclosure obligations
  • Acts in your best interests
  • Information stays confidential
Option 2 — Applies Here

As a Non-Client

  • No representation
  • No duty of loyalty
  • No full disclosure duty
  • Does not act in your best interests
  • Shared info may not be confidential

They must still act honestly, professionally, and with reasonable care and skill, as required by law.

Why You're Being Asked to Acknowledge This Form

You are being asked to acknowledge this disclosure so you understand whether or not you are being represented, what duties are owed to you, and what protections apply at this stage. This is common when:

  • You are requesting general information
  • You are in early conversations
  • You have not yet chosen to be represented
  • You are dealing with a real estate team and representation has not been established

What Acknowledging the Form Means

It confirms that you
  • Received the information
  • Understand your current relationship with the real estate professional
It does not
  • Make you a client
  • Commit you to working with anyone
  • Prevent you from becoming a client later

Optional Next Step

Want Full Representation?

If you later decide you want representation, a separate written agreement would be required to establish a client relationship and full legal duties. There's no obligation — this form simply starts the conversation on the right foot.
